Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tsumida AI Inc. ("we", "us"), the operator of Sidequest, and govern your use of Sidequest, our mobile app for guided audio quests (the "Service"). By creating an account or using the Service, you agree to these Terms.

Sidequest is an early product. Quests, features and content may change, break or be removed, and the Service is provided on an "as is" basis while we build it.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your country) to use Sidequest. You sign in with Google, Apple or a one-time code sent to your email, or use the app as a guest; you are responsible for the security of those accounts and for all activity under yours. Your Sidequest account is a Tsumida AI account and may be shared with other Tsumida AI apps, as described in our Privacy Policy.

2. The Service

Sidequest guides you along a route through real streets and public places, plays a story at each stop, and asks you to find things with your phone's camera. The routes, stories, recordings, artwork and cards are ours (see section 6).

A quest is downloaded, not streamed. The app lists the quests we have published and, when you pick one, downloads the whole of it (the words, the pictures and every audio clip) to your phone before you set off, so that the quest works with no signal. Getting it needs a connection, and the data it uses is yours to pay for. We may publish new quests, change a quest you already hold, or stop publishing one; a quest we take down stays on your phone until you remove it or delete the app, but we cannot promise you can fetch it again.

3. Walking is on you

A quest takes place in the real world, and the real world is not something we control. You are responsible for your own safety while using Sidequest. In particular:

• Watch where you are going. Do not use the app in a way that takes your attention off traffic, cyclists, other people, steps, water or the edge of anything.
• Obey traffic signals, signs and the law. A route is a suggestion, never permission to cross where you should not or to enter somewhere you may not.
• Respect private property, residents and businesses. Stops are in public places; if something looks like it is not, do not go there.
• Use your judgement about weather, daylight, your own condition and the neighbourhood. Stop if a quest does not feel right.
• Location can be wrong, especially between tall buildings. If the app and the street disagree, trust the street.

The camera features overlay pictures on the world; they do not see hazards for you.

4. Acceptable use

When using Sidequest, you agree not to:

• use the Service for any unlawful, harmful or abusive purpose, or to trespass, harass or endanger anyone;
• attempt to disrupt, overload, reverse engineer or gain unauthorised access to the Service or its systems;
• copy, record, redistribute or publicly perform the quests, stories, audio or artwork, other than as the app itself allows; a quest downloaded to your phone is licensed to you for walking it, and the files are not yours to pass on;
• use automated means to access the Service beyond normal personal use.

5. Your content

You retain ownership of what you provide: your name, bio, photo and interests. You grant us a limited, non-exclusive licence to store and display that content solely to operate the Service for you. You are responsible for it and for having the right to use it. A profile photo is stored at a public web address, which the Privacy Policy explains; do not upload a picture you would not want handed to whoever holds that address.

6. Our content and intellectual property

The Sidequest name, software, design, routes, stories, recordings, artwork, clues and cards, and other materials we provide are owned by us or our licensors and are protected by law. These Terms give you a personal, non-transferable licence to use them within the app for your own quests, and nothing more. They do not grant you any right to use our trademarks or branding without our prior written consent.

7. Third-party services

The Service uses sign-in from Apple and Google, and draws its map with the one built into your phone (Apple Maps on iPhone, Google Maps on Android). We do not control and are not responsible for third-party services, and your use of them may be subject to their own terms.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that a quest will download or remain available, that a route will be passable, that a place will be open, or that anything the story says about a place is accurate.

9. Limitation of liability

To the maximum extent permitted by law, Sidequest and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, loss of data, profits or goodwill, arising out of or relating to your use of the Service, including anything that happens while you are on a quest. Our total liability for any claim relating to the Service will not exceed the greater of USD 50 or the amount you paid through the Service in the twelve months before the claim arose.

10. Termination

You may stop using Sidequest and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content licences, disclaimers and limitations of liability) will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Japan, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in Japan.
